The purpose of this White Paper is to set out an integrated EU approach to contribute to reducing ill health due to poor nutrition, overweight and obesity. The Paper builds on recent initiatives undertaken by the Commission in particular the EU Platform for Action on Diet, Physical Activity and Health 1 and the Green Paper "Promoting healthy diets and physical activity: a European dimension for the prevention of overweight, obesity and chronic diseases" 2 . The last three decades have seen the levels of overweight and obesity 3 in the EU population rise dramatically, particularly among children, where the estimated prevalence of overweight was 30% in 2006. This is indicative of a worsening trend of poor diets and low physical activity levels across the EU population which can be expected to increase future levels of a number of chronic conditions, such as cardiovascular disease, hypertension, type 2 diabetes, stroke, certain cancers, musculo-skeletal disorders and even a range of mental health conditions. In the long term, this will result in a negative impact on life expectancy in the EU, and a reduced quality of life for many.

Regulation (EC) N° 1924/2006 * of the European Parliament and of the Council on nutrition and health claims made on foods (hereafter “the Regulation”) was adopted on 20 December 2006. This Regulation lays down harmonised rules for the use of nutrition and health claims and contributes to a high level of consumer protection. It ensures that any claim made on a food label in the EU is clear, accurate and substantiated, enabling consumers to make informed and meaningful choices. The Regulation also aims to ensure fair competition and promote and protect innovation in the area of food. Following an informal working practice, the Commission’s Health and Consumer protection Directorate General has set up a Working Group with experts from Member States in order to examine a series of issues concerning the implementation of the Regulation, notably on the classification of claims. The Standing Committee on the Food Chain and Animal Health has approved the following conclusions at its meeting on the 14 December 2007. The present document aims to assist the interested stakeholders to better understand and to apply correctly and in a uniform way the Regulation. However, this document has no formal legal status and in the event of a dispute, ultimate responsibility for the interpretation of the law lies with the Court of Justice.

O n 8 June 2010, the Employment, Social Policy, Health and Consumer Affairs Council adopted conclusions on action to reduce population salt intake for better health1. The Council Conclusions set out the political commitment by Ministers towards the shared objectives and goals of the common European Union Framework on voluntary national salt2 initiatives (the ‘Framework’)3 and gave added momentum to implementation efforts. The Conclusions welcomed the work on the Framework since 2008 of the High Level Group on Nutrition and Physical Activity (the ‘High Level Group’) chaired by the European Commission and confirmed the need for a regular monitoring to measure progress. Following the mandate of the Council, the Commission services compiled this report providing an analysis of the situation and actions taken in the European Union (EU) and its Member States in 2012. This report is an overview and synthesis of responses to a questionnaire sent to Member States in August 20124. The questionnaire sought to capture activities at national level from mid-2008 until mid-2012 that had taken place within the context of the Framework.

Case Study report: Food / drink reformulation July 2010 Reformulation efforts by many large industry players began well before the set-up of the EU Platform for Action on Diet, Physical Activity and Health in response to a need to be socially responsible in the face of pressure from consumer organisations and governments. However, industry’s commitments in this area have been given a broader EU remit and a more level playing field among competitors thanks to the consensus building undertaken by trade associations and within the framework of the EU Platform. In light of this trend towards wider and better product reformulation by companies, and as stipulated in the Terms of Reference, the objective of the case study on food/drink reformulation is to establish how well self-regulation in the area is being implemented and what effect it is having. In addition, it will seek to respond to the specific evaluation question: ‘What was the impact of self-regulation commitments on EU or national regulatory initiatives?’. The following case study comprises two elements: · A descriptive analysis of all the Platform commitments in the area of food / drink reformulation; · The in-depth study of three commitments though interviews with industry, not-for-profit Platform members and experts; and in-depth research to seek to provide an evidence base to the more contentious issues, as per the interviews.
